The following T.O.S is for my artwork in general - for my commission or design specific T.O.S please carry on using the buttons below.

My Artwork

All of my work is done without the usage of AI. I intend to keep it that way. Please respect my choices.Do not edit, trace, or draw over my artwork - commission or not. If you have commissioned work from me, please ask for a touch up if something appears off or if you would like something quickly changed.Do not feed my art to AI. This includes past, present and future artwork - commission or not.Do not redistribute or repost my artwork. My work is available for all to view via social medias, so please do not claim my work as your own or post without consent from me.

Use & Posting Commissioned Work

You are welcomed to use my art as a print for yourself, as a profile picture and/or banner, or for self-training.
Please provide credit when doing so.You are welcome to post your commissioned artwork on social media even if I haven't yet so long as you credit me appropriately.You are welcome to print your commission for personal use. You may only sell prints of your commission if you pay for the Commercial Merchandising Rights to your piece.Please do not use my artwork for projects I have not agreed to without commercial rights.As mentioned previously, do not edit / trace / draw over / AI my art.

Ko-fi Memberships

I offer specific benefits to those who support me via Ko-fi Membership such as raw .psd files, timelapses, and more.Do not redistribute these rewards to those outside of the membership.
I will discontinue further postings if I find out my work files are being shared to outside sources.I do not offer refunds to members as majority of the rewards are digital media and cannot be revoked from the member afterwards.

Supporters

Anyone who supports me via Twitch Subscriptions, Ko-fi donations, Ko-fi memberships, etc. will receive an exclusive role and channel within my discord that provides early access and voting on Adoptables.Please do not share these exclusive rewards and previews to those outside of the channel or I will remove the exclusive features entirely.

Waitlist

I use a waitlist to make progress on my commissions - this waitlist is capped at 15 people and will open whenever 5 or more slots open.Once on the waitlist you are welcome to cancel at any time without any charges.
Frequent cancellations will have you on my do-not-serve list for future commissions.If you put a specific deadline for your commission I will adjust your position on the waitlist accordingly. If your deadline is short-notice or if my current workload is heavy then I may have to charge a priority fee.You have 1 week to respond to the Proposal I send you before I decline your commission UNLESS it is communicated with me that you need more time. I am very flexible, so please don't hesitate to DM me.

Payment Plans & Refunds

I am willing to do Payment Plans for any of my services , however I do not begin the work until 50% has been paid - All updates and files will be heavily watermarked until 100% is paid.I do not offer refunds once we have both agreed on a proposal - I only offer refunds if I fail to deliver the product or if I need to cancel to commission on my end for any reason.

Communication

Please only contact me on VGen regarding commissions.You are welcome to DM me on Ko-fi or VGen regarding adoptable / shop purchases.Please do not contact me on social media (Twitter, Bluesky, Instagram) regarding commissions or business inquiries. I often don't check these DMs and assume most people are bots.

Disclaimers

I work on personal projects between commissions as art will always be a way for me to relax - please understand and respect this if you commission me.

General

Do not edit, trace, or draw over my artwork - commission or not. If something needs fixing or alteration then please ask, I am very understanding.Do not feed my art to AI. This includes past, present and future artwork - commission or not.

Revisions & Updates

I offer updates for milestones ; Sketch, Lineart, Colour, Final.
For some commissions, like YCH's, I will skip the colour update as most of the colours are already decided, however colours can still be fixed during the final review if needed!Please do not ask for updates too frequently - I have a Trello you can access at any time to see where your commission stands. If you require extra updates for reassurance then please communicate that with me and I will do my best to adhere to your request.During the Sketch phase you can make any alterations you would like at no extra cost, with no limits - After the sketch I will only accept small alterations for free, anything larger such as changing the pose or the outfit will result in an extra fee.

Surprise / SKEB Commissions

Surprise / SKEB Commissions refer to a commission type where no WIPs or Updates are provided to the client during the commission process.
You provide me the character reference and the "mood" you would like for the piece - I choose the pose, the lighting, the background, etc.You only get the ability to ask for fixes at the very end of the process. These fixes are limited to the design of the character incase I misunderstood or forgot an aspect of the character design. Nothing else can be adjusted.Any and all commissions following under this category on my VGen and elsewhere follow these rules.If you would like more control of your commission, please submit a request for my regular illustration services.

Deadlines & Delivery

I treat my set deadlines like an expected delivery date - expect your commission to arrive closer to the date listed. I guarantee delivery between roughly 1-2 months unless a specific date is requested.If I need more time I will contact you before submitting a date change request.Rush fee may apply depending on the requested deadline.I will decline any deadline that is within 7 days of form submission

Use & Posting

You are welcome to post my artwork on social media even if I haven't yet so long as you credit me appropriately.You are welcome to print your commission for personal use. Intellectual Property Rights & Other Rights

As the artist, I always have the Intellectual Property RightsAs the commissioner, you have Personal & Monetized Rights such as printing, streaming, etc.As the commissioner, you can pay for Merchandising Rights, but you do not have it by default.

Payments & Refunds

"What art program / art tablet do you use?"

I primarily use Clip Studio Paint Pro on my XP-Pen 15.6 Artist Pro - I do also use Procreate on my Gen 9 ipad from time to time but not for full pieces.

"What is your canvas size and what brushes do you use?"

Standard Projects are 6000x6000 @ 350 DPI.
Emotes are 500x500 @ 350 DPI
(16:9) Banners are 9600x5400 @ 350DPI

"How long of a wait is the Waitlist?"

With my waitlist now being capped at 15 people at a time, I'd expect the total wait to be anywhere around 2-3 months at it's max capacity.This is not a guarantee, and can vary depending on my workload.

"Your waitlist is long but I have a deadline, is there an exception?"

Yes and No.I try to be as fair as I can to those who commission me, and I am willing to work with people that have a hard deadline if my workload is lighter so long as the deadline isn't too short of a notice.
Rush fee will apply for deadlines shorter than 1 month of notice.However, if my workload is heavy or if I already have 1-2 hard deadline commissions on the go, I am more likely to decline.

"Do you only accept VGen comms?"

Mostly, Yes - I do some one off commissions that are exclusive to Ko-fi members when I need an extra buck or want to try something new but otherwise I don't do anything through DM's.Friends & Family are the only exception otherwise.

"What is your turn around time?"

Once I begin the sketch, the turn around time is roughly 1-2 months depending on the commission. I make sure to communicate if I feel more time is needed than I initially expected!

"Why does it take 1+ month for a commission?"

I allow a 1+ month window as to not overwhelm myself, especially if I take several comms at once. It gives me time to work on everyone without rushing and also allows me days to relax!

"How does your Loyalty Card work?"

Each commission type offers 1 stamp to your card - Mega Emote Bundles offer 3 stamps to your card.
This card will be sent to you with the updated stamps each time you commission me.At 5 stamps you can request a B&W Sketch commission in either of my styles (Chibi or Regular) of 1-2 characters of your choice!At 10 stamps you can re-order a previous commission at no extra charge!
Example ; if you have previously ordered a bundle of 3 emotes, you can order it again with new emotes selected and/or a new character as a reference!You may try to haggle addons or a different commission type instead of a previously purchased one,
but I have the right to decline if I feel it is unfair of a swap.Mega Emote Bundles CANNOT be redeemed as a free commission type as it simply is just too much work for me to offer for free - however they do provide 3 stamps rather than 1 to make up for it.To redeem your rewards, please contact @deamarii via VGen - if you do not claim your commission at 10 stamps then your Loyalty Card will be paused until you do redeem to prevent a backlog of free comm redeems.These loyalty comms would be done between paid work and are not going to have set due dates.

Process

SKETCHES
I will offer you 4 sketches that are included within the price, here you can choose a sketch you like the most and tweak it to better suit your liking. We can also mix and match the sketches if you like several of them.

COLOURS
Once you are satisfied with the sketched design we will begin colour combinations.I will provide you 3 colour combos where similar to the sketch phase you will pick 1 or mix and match them then slightly tweak where needed.

REVISED DESIGN
I will then take the sketch and colour design, clean it up and provide you a mini reference sheet including a front view, back view, and a palette for future artist's to work off of.

*Outfit Design includes 1 hairstyle design. If you would like 2 total hairstyles, you will choose the "extra hairstyle" add-on.

Design T.O.S

Please keep in mind that my general & commission T.O.S apply to this service as well.

  • This commission service relies on frequent and quick communication for a seamless delivery. Please frequently check your DM's on VGen through the entire process.

  • An extra fee may apply if references are unclear or difficult to understand.

  • Please limit your references as much as you can, it's very difficult to figure out what you are wanting if I have 20+ images to sort through. If you need, make a collage/mood board for each item (shirt, pants, coat, etc.) to limit total files sent.

  • I do not work purely from description, please provide some form of reference whether it be IRL or inspiration images.

  • This commission does not come with lineart or rendering of any sort. It will be a clean sketch with readable shapes & colours. If you wish for lineart & rendering then consider the Reference Sheet add-on.

  • Due to my lack of skill within the genre of work, I do not design weapons or large props.

  • All add-ons percentages are determined by the base price.
